Thailand Trademark Registration
To protect a trademark in Thailand, the application must be filed with the Department of Intellectual Property (DIP). The Nice Classification system is used for the classification of goods and services, and multi-class applications are allowed.
Trademark Search
Before applying for a trademark, you may conduct a search to find out if there are any identical or similar marks already registered. This step is optional but recommended before filing your application.
Time frame: 5 – 7 working days
Trademark Application
Once the trademark application is filed, it will undergo formality checks and substantive examination by the examiner. If an objection is raised, the applicant must respond within the prescribed period; otherwise, the application will be deemed abandoned. If no objection is raised, the application will be published in the Official Journal. Any interested party may file an opposition within 60 days from the date of publication. If no opposition is filed, the trademark will be registered, and a certificate of registration will be issued.
Time Frame
The processing time from filing to registration generally takes about 9–12 months. However, if there are objections from the Trademark Office or oppositions from third parties, the process may take longer.
Validity of Registration:
A registered trademark in Thailand is valid for 10 years from the date of application, and can be renewed every 10 years.
Requirements For Trademark Application in Thailand:
- Applicant’s name and address
- Representation of the trademark
- Classes and description of goods or services
- Notarized Power of Attorney
- A certified translation and transliteration are required if the trademark contains words other than English or the national language.
- If the applicant claims convention priority, a certified copy of foreign application is required (with English translation).
